Coll de Rates Cycling Holidays is a commercial brand operated by HOMEINCALPE INVEST S.L. In these Terms and Conditions, HOMEINCALPE INVEST S.L. is referred to as the Company and the person or entity renting the equipment is referred to as the Customer.

2. Scope and acceptance

These Terms and Conditions apply to the rental of bicycles and accessories supplied by the Company through its shop, website, external booking platform or other authorised booking channels.

The rental contract is formed when the booking or rental is accepted by the Company and the Customer accepts the applicable terms. The booking confirmation, selected dates, bicycle model, accessories, delivery or collection options, price and any specifically accepted additional conditions form part of the rental contract.

Before completing a booking, the Customer must have a real opportunity to read and accept the version of these Terms and Conditions that applies to the rental.

3. Eligibility and identification

The person entering into the rental contract must be at least 18 years old and legally capable of contracting. A rider under 18 must be accompanied by and remain under the responsibility of an adult over 18.

The Customer must present a valid identity card or passport when collecting the bicycle. The Company may refuse to hand over the equipment if valid identification is not provided.

Where a Customer books for other riders, the Customer is responsible for ensuring that those riders know and comply with the obligations relating to use, care and return of the equipment.

4. Booking and availability

Bookings are subject to availability. Bicycle models, sizes and accessories are allocated according to the information provided during the booking process.

The Customer is responsible for entering accurate contact, rider, sizing and booking information. Requests to change dates, bicycle models, sizes, accessories, delivery or collection arrangements are subject to availability and cannot be guaranteed.

If the selected equipment becomes unavailable for reasons outside the Company's reasonable control, the Company will contact the Customer to offer an appropriate solution in accordance with applicable law.

5. Prices and payment

Prices are stated in euros. The total price and any selected accessories, delivery services or optional cover must be shown before the Customer confirms the booking.

For online bookings, the Customer must pay a deposit equal to 25% of the total rental price during the booking process. The remaining 75% must be paid in full before the bicycle is handed over to the Customer.

6. Cancellations, changes and early returns

The Customer must contact the Company as soon as possible to request a cancellation or change. Changes remain subject to availability.

Any cancellation, refund, no-show or early-return rules shown to and accepted by the Customer during the booking process will apply to the booking.

7. Collection, delivery and return

The Customer must collect and return the bicycle and accessories at the agreed place, date and time. Unless an alternative has been agreed in advance, shop collections and returns must take place during the Company's opening hours.

Delivery and collection services depend on location, availability and the conditions displayed during booking. Any additional charge must be shown before the booking is confirmed.

The bicycle and accessories must be returned in the same condition in which they were supplied, except for reasonable wear resulting from proper use.

8. Customer responsibility and care of equipment

The Customer is responsible for the bicycle and every rented or supplied accessory throughout the rental period, including tools, helmet, pedals, lock, saddle bag, pump, GPS or cycling computer and any other equipment listed in the booking or handover record.

The Customer must:

  • use the equipment carefully and only for its intended purpose;
  • follow the Company's reasonable operating and safety instructions;
  • protect the equipment from damage, loss and theft;
  • stop using the bicycle and contact the Company if it becomes unsafe or develops a fault; and
  • return all equipment included in the rental.

The Customer must not sell, sublet, lend, modify or otherwise dispose of the equipment without the Company's prior authorisation.

9. Security and lock

The Company will provide one security lock for each bicycle at no additional charge.

Whenever the bicycle is left unattended, the Customer must lock it securely to an appropriate fixed object and take reasonable precautions to prevent theft or damage. Providing a lock does not transfer responsibility for the bicycle to the Company while it is in the Customer's possession.

10. Theft, loss and reporting obligations

If a bicycle or accessory is stolen, lost, destroyed or damaged, the Customer must:

  1. notify the Company as soon as reasonably possible;
  2. report any suspected theft or criminal act to the police or competent security authority; and
  3. provide the Company with a copy of the report within 24 hours of becoming aware of the incident, where reasonably possible.

The optional cover described in section 12 does not cover the disappearance or theft of the bicycle. The Company does not currently offer theft insurance. Customers are advised to check whether their own travel or other insurance covers rented bicycle theft.

11. Damage, loss and non-return charges

Subject to applicable law, the Customer is responsible for the reasonable cost of repairing damage caused during the rental period beyond normal wear and for replacing equipment that is lost, stolen, destroyed or not returned.

In the event of theft or non-return, this includes the replacement value of the bicycle and any missing accessories. Damage charges will correspond to the cost of repairing or replacing the damaged equipment.

12. Optional insurance or damage cover

The Company offers recommended optional insurance covering damage that may be caused to the bicycle during the rental period. This insurance has a franchise of up to EUR 500. If the cost of repairing the damage exceeds this amount, the Customer must pay the remaining amount until the total repair cost is covered.

The optional insurance does not cover the disappearance or theft of the bicycle. If the Customer does not choose the recommended optional insurance, the Customer is responsible for damage caused to the bicycle during the rental period and for the cost of any rented accessory that is not returned.

Garmin Edge Explore rental devices are not considered accessories for the purposes of this insurance and are not covered by it. If a device is lost, disappears or is stolen, the Customer must pay its full replacement cost. Damage to the device will be treated in accordance with the damage conditions stated in this section.

Nothing in this section limits any mandatory right or liability that cannot legally be limited.

13. Late return

If the equipment is returned after the agreed time without prior authorisation, the Company may charge the additional rental time at the applicable single-day rate, without prejudice to any further reasonable loss directly caused by the late return and recoverable under applicable law.

The Customer should contact the Company before the agreed return time if an extension is required. Extensions are subject to availability and are not confirmed until accepted by the Company.

14. Safe and lawful use

The Customer and every rider must comply with applicable road traffic, safety and local rules. Each rider is responsible for fines, penalties and consequences resulting from their own breach of those rules.

The Customer acknowledges that cycling involves inherent risks and must ride responsibly, choose routes appropriate to the rider's ability and conditions, and use suitable safety equipment.

The Customer is responsible for damage caused to third parties or property through the Customer's or rider's negligent, unlawful or improper use of the equipment, subject to applicable law.

15. Breakdowns and roadside assistance

Roadside assistance is included where a mechanical problem makes the rented bicycle unsafe or impossible to ride. The Customer must stop riding when it is unsafe to continue and contact the Company for instructions.

Roadside assistance is available up to 100 km (62 miles) from the Customer's accommodation. The Customer must contact the Company using the contact details provided in the booking confirmation or rental documentation so that assistance can be arranged.

16. Prohibited use

Bicycles must not be used on the beach or in sand. Damage caused by sand, salt or prohibited use may be assessed and charged in accordance with sections 11 and 12.

The equipment must not be used for unlawful purposes or in a manner that is manifestly unsuitable for the type of bicycle supplied.

17. Company responsibility

The Company is responsible for supplying equipment that complies with applicable requirements and is in an appropriate condition for the agreed rental use.

To the extent permitted by law, the Company is not responsible for loss or damage caused solely by the Customer's misuse of the equipment, breach of traffic rules, failure to follow safety instructions or unauthorised modification of the equipment.

Nothing in these Terms and Conditions excludes or limits liability that cannot legally be excluded or limited, including the mandatory rights of consumers and users.

18. Complaints and contact

Questions, incidents, complaints or claims may be submitted through the contact form, by email to info@collderatescycling.com, by telephone on +34 613 04 00 09, or at the Company's registered office.

19. Personal data

Personal data relating to enquiries, bookings and rental services will be processed in accordance with the Privacy Policy and the privacy information presented through the applicable booking channel.

Where the Customer enters information directly on an external booking or payment platform, the privacy information and roles identified on that platform also apply.

20. Applicable law and jurisdiction

The rental contract and these Terms and Conditions are governed by Spanish law.

Any dispute will be submitted to the courts determined by applicable law. Where the Customer is a consumer, this clause does not affect any mandatory jurisdiction or consumer protection rights that apply to the Customer. The reference in the source document to the courts of Calpe or Alicante must not override a consumer's mandatory right to bring or defend proceedings before the court established by law.

21. Severability and precedence

If any provision is held to be invalid or unenforceable, the remaining provisions will continue to apply to the extent legally possible.

If a booking confirmation contains a specifically agreed condition that conflicts with these general terms, the specifically agreed condition will prevail only to the extent permitted by applicable law. Mandatory consumer rights always prevail.
